X. Conclusion
The ATCA is more than 200 years old and less than three dozen words
long. In the current climate of corporate human rights violations, the inter-
pretation of the ATCA as to corporate liability must ultimately boil down to
policy considerations. The legal arguments for and against ATCA corpo-
rate liability both have their respective merits under international law, but
as a matter of policy and good conscience, corporate liability should pre-
vail. Without a definite answer to the liability question, corporations are free
to drag out ATCA lawsuits — or worse yet, settle suits for comparatively
meager sums, while enjoying an escape from a federal court’s spotlight on
overseas activity.
