Luz Nagle, As Co-Chair of the IBA Crimes Against Women Subcommittee, gave comments on the UK’s February 2018 Supreme Court ruling in which two victims of serial rapist John Worboys won a compensation claim after the Court upheld that the police had failed in their duty under Article 3 of the European Convention on Human Rights to investigate serious violence against women. Also discussed the application of the ECHR in criminal investigation and prosecution for violence against women, and its implications for rape trials going forward. Reviewed and commented on the national digital disclosure form rolled out in 2019, which has brought the controversial practice of requesting victims’ consent to review digital data in sexual assault cases back into the spotlight.
