{"id":61597,"date":"2023-04-11T14:34:00","date_gmt":"2023-04-11T18:34:00","guid":{"rendered":"https:\/\/www2.stetson.edu\/law\/docket\/?p=61597"},"modified":"2023-04-04T14:34:46","modified_gmt":"2023-04-04T18:34:46","slug":"sba-constitution-by-laws-committee-proposed-changes-3","status":"publish","type":"post","link":"https:\/\/www2.stetson.edu\/law\/docket\/sba-constitution-by-laws-committee-proposed-changes-3\/","title":{"rendered":"SBA Constitution &#038; By-Laws Committee Proposed Changes"},"content":{"rendered":"\n<p>SBA Constitution &amp; By-Laws Committee Proposed Changes<\/p>\n\n\n\n<p>Under Article VII of the SBA By-Laws, Amendments to the By-Laws shall be by \u201ca two-thirds (2\/3) vote of the Legislative Council.<\/p>\n\n\n\n<p>Article VII also stipulates that proposed Amendments \u201cshall be submitted in writing to the Executive Council and shall thereafter be posted continuously for a two (2) week period prior to the vote of the Legislative Council. Note that proposed amendments only affect \u201cthe Executive and Legislative Council, as well as any recognized Student Organization.\u201d<\/p>\n\n\n\n<p>The proposed changes submitted here are meant to serve as the beginning of the two-week period for posting prior to the formal vote by members of the Legislative Council.<\/p>\n\n\n\n<p><strong><u>SBA By-Laws<\/u><\/strong><\/p>\n\n\n\n<p>Article I, Section 1 \u2013 OFFICER\u2019S DUTIES<\/p>\n\n\n\n<p>Change Subsection c.: \u201cThe President shall, at the beginning of his\/her term of office and anytime thereafter as may be necessary due to vacancies, appoint chairpersons to All Committees, Standard and Special, unless otherwise stated below.\u201d<\/p>\n\n\n\n<p>New Language: \u201cThe President shall, at anytime as may be necessary due to vacancies, appoint chairpersons to all Committees, Standard and Special, unless otherwise stipulated below.\u201d<\/p>\n\n\n\n<p>Article II, Section 2 \u2013 DUTIES<\/p>\n\n\n\n<p>Add New Paragraph 6: \u201cEach member of the Legislative Council will be required to serve on a committee unless otherwise excused by the Executive Board, the President of the Association, or the Legislative Council.\u201d<\/p>\n\n\n\n<p>Article II, Section 3 \u2013 MEETINGS<\/p>\n\n\n\n<p>Add New Paragraph 2: \u201cDuring the first meeting of the Legislative Council in the Fall semester, committee assignment will be performed by a temporary special member of the Legislative Council, the Speaker of the Legislative Council, who will assign members to the different standing committees. The Speaker shall be selected, by a simple plurality vote, during the opening business of the first meeting of the Fall semester for the sole express purpose of committee assignment. Members of the Legislative Council may put forth themselves or other members for candidacy.\u201d<\/p>\n\n\n\n<p>Article II, Section 4, Paragraph 7 \u2013 ATTENDANCE OF MEETINGS<\/p>\n\n\n\n<p>Change: \u201cIf an elected representative of the Legislative Council or the Summer Advisory Council is removed from office for violating the attendance policy, the By-Laws Committee shall serve as a review committee should the representative want to appeal his\/her dismissal. The committee shall investigate the circumstances surrounding the absences and make a recommendation to Executive Council for either reinstatement as a representative or final removal. The Executive Council shall then vote, and the representative may be reinstated by a two-thirds (2\/3) vote.\u201d<\/p>\n\n\n\n<p>New Language: \u201cIf an elected representative of the Legislative Council or the Summer Advisory Council is removed from office for violating the attendance policy, the By-Laws Committee shall serve as a review committee should the representative want to appeal his\/her dismissal. The committee shall investigate the circumstances surrounding the absences and make a recommendation to Executive Council for either reinstatement as a representative or final removal. The recommendation by the By-Laws Committee shall be binding, unless overridden by two-thirds (2\/3) vote by the Legislative Council during a regular meeting.\u201d<\/p>\n\n\n\n<p>Article III, Section 1 \u2013 CREATION<\/p>\n\n\n\n<p>Add New Second Paragraph: \u201cThe Speaker of the Legislative Council, who shall be selected during the opening business of the first meeting of the Fall semester, will be tasked with assigning Legislative Council members to the standing committees. Once assigned to committees, members of that committee shall, by a simple plurality vote, select the Chair of that committee.
