The <a href=\"http:\/\/www.flcrc.gov\/Proposals\/Commissioner\/2017\/0023\/ProposalText\/Filed\/PDF\">proposed amendment<\/a> will be considered by the Florida CRC Judiciary Committee in Tallahassee on Nov. 28.<\/p>\n<figure id=\"attachment_24758\" aria-describedby=\"caption-attachment-24758\" style=\"width: 235px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2017\/11\/ClayHendersonCrop.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-24758\" src=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2017\/11\/ClayHendersonCrop-235x300.jpg\" alt=\"Clay Henderson.\" width=\"235\" height=\"300\" \/><\/a><figcaption id=\"caption-attachment-24758\" class=\"wp-caption-text\">Clay Henderson.<\/figcaption><\/figure>\n<p>The \u201cright to a clean and healthy environment\u201d proposal or P23, sponsored by Commissioner Jacqui Thurlow-Lippisch, would amend the Florida Constitution to provide that \u201cthe natural resources of the state are the legacy of present and future generations\u201d and \u201cevery person has a right to a clean and healthful environment, including clean air and water.\u201d<\/p>\n<figure id=\"attachment_21951\" aria-describedby=\"caption-attachment-21951\" style=\"width: 200px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2016\/11\/Lance-Long_WEB.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-21951\" src=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2016\/11\/Lance-Long_WEB-200x300.jpg\" alt=\"Lance Long.\" width=\"200\" height=\"300\" \/><\/a><figcaption id=\"caption-attachment-21951\" class=\"wp-caption-text\">Lance Long.<\/figcaption><\/figure>\n<p>Henderson, executive director of Stetson University\u2019s Institute for Water and Environmental Resilience, proposed the right to a clean environment at a public hearing in Jacksonville earlier this year.<\/p>\n<p>\u201cFloridians have demonstrated time and again that protection of the environment is a fundamental value that should rise to a constitutional level of protection,\u201d Henderson said.<\/p>\n<p>\u201cThe proposed amendment provides Florida citizens with a constitutionally enforceable right to a clean and healthful environment,\u201d said Long. \u201cIt does not create an independent right to bring legal action, but it does set a standard applicable to any action by a private or public party.\u201d\u00a0 Long teaches legal research and writing, and environmental law and environmental advocacy at Stetson University College of Law in Gulfport, where he also serves as faculty adviser to the Go Green Committee on campus.<\/p>\n<figure id=\"attachment_24781\" aria-describedby=\"caption-attachment-24781\" style=\"width: 235px\" class=\"wp-caption alignright\"><a href=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2017\/11\/KaiSuCourtyard.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-24781\" src=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2017\/11\/KaiSuCourtyard-235x300.jpg\" alt=\"Kai Su.\" width=\"235\" height=\"300\" \/><\/a><figcaption id=\"caption-attachment-24781\" class=\"wp-caption-text\">Kai Su.<\/figcaption><\/figure>\n<p>The proposal was drafted by a small group of environmental lawyers including Henderson and Long. Stetson law student Kai Su helped prepare the proposed amendment by researching similar provisions in other states.
