{"id":28574,"date":"2019-11-04T10:55:54","date_gmt":"2019-11-04T15:55:54","guid":{"rendered":"https:\/\/www.stetson.edu\/law\/news\/?p=28574"},"modified":"2019-11-04T11:39:59","modified_gmt":"2019-11-04T16:39:59","slug":"director-of-stetsons-veterans-law-institute-examines-veterans-second-amendment-rights-in-article","status":"publish","type":"post","link":"https:\/\/www2.stetson.edu\/law\/news\/index.php\/2019\/11\/04\/director-of-stetsons-veterans-law-institute-examines-veterans-second-amendment-rights-in-article\/","title":{"rendered":"Director of Stetson\u2019s Veterans Law Institute examines veterans\u2019 Second Amendment rights in article"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.stetson.edu\/law\/news\/wp-content\/uploads\/2012\/10\/Stacey-RaeSimcox_2014_WEB.jpg\" alt=\"Professor Stacey-Rae Simcox.\" class=\"wp-image-16130\" width=\"161\" height=\"242\" srcset=\"https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2012\/10\/Stacey-RaeSimcox_2014_WEB.jpg 350w, https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2012\/10\/Stacey-RaeSimcox_2014_WEB-333x500.jpg 333w\" sizes=\"auto, (max-width: 161px) 100vw, 161px\" \/><figcaption>Professor Stacey-Rae Simcox.<\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The article, &#8220;Depriving Our Veterans of Their Constitutional Rights: An Analysis of the Department of Veterans Affairs\u2019 Practice of Stripping Veterans of Their Second Amendment Rights and Our Nation\u2019s Response&#8221; by Professor Stacey-Rae Simcox, was accepted for publication in the <em><a href=\"https:\/\/www.utahlawreview.org\/article\/7673-depriving-our-veterans-of-their-constitutional-rights-an-analysis-of-the-department-of-veterans-affairs-practice-of-stripping-veterans-of-their-second-amendment-rights-and-our-nation-s-response\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Utah Law Review<\/a><\/em> in March. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Introduction<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;<em>The oath that every enlisted member and officer of the United States Armed Forces takes before serving includes the solemn promise to \u201csupport and defend the Constitution of the United States against all enemies, foreign and domestic\u201d and to \u201cbear true faith and allegiance to the same.\u201d This oath contains no time limit and many veterans consider themselves to be bound by these promises for their entire lives.<\/em>&#8220;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Article<\/strong> <strong>Summary<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, the VA has been\ntreading on the rights of veterans by systematically stripping them of their\nSecond Amendment right to possess a firearm.&nbsp; Divesting a veteran of his\nor her constitutional rights in a manner that affords less protections than\nother citizens receive creates an unconstitutional infringement of the\nveteran\u2019s Second Amendment rights under the United States Constitution.&nbsp;\nThis situation is particularly ironic and shameful when one considers the\nlasting oath of all who have served in the Armed Forces of the United States to\nsupport and defend the Constitution above all else.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article contrasts and compares the determination of financial incompetency in the VA to other determinations of \u201cmental defectiveness\u201d in order to demonstrate that the VA\u2019s standards do not rise to the level of \u201cadjudicat[ing] [the veteran] a mental defective\u201d necessary to be stripped of his constitutional rights.\u00a0 This article also argues that including veterans determined financially incompetent for VA purposes on a list of persons unable to exercise their Second Amendment rights is an unconstitutional deprivation of these rights and must be remedied not only for those veterans who may be affected in the future, but for those veterans who find themselves in this situation currently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>About Professor Simcox<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.stetson.edu\/law\/faculty\/simcox-stacey-rae\/index.php\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Stacey-Rae Simcox (opens in a new tab)\">Stacey-Rae Simcox<\/a> is a Professor of Law and Director of Stetson University College of Law\u2019s Veterans Law Institute and Veterans Advocacy Clinic.
