In April, the federal agencies published the <a href=\"https:\/\/www.epa.gov\/nwpr\/final-rule-navigable-waters-protection-rule\">Navigable Waters Protection Rule<\/a>, which more narrowly defines which waters constitute navigable waters\u2014and thereby considerably restrict the wetlands and other waters that are federally protected under the CWA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">States from across the country, including California, New York, and Wisconsin, filed a lawsuit and have since petitioned to temporarily block the new rule from taking effect. Stetson\u2019s <a href=\"https:\/\/www.stetson.edu\/law\/faculty\/gardner-royal-c\/\" target=\"_blank\" rel=\"noreferrer noopener\">Royal Gardner<\/a>, professor and director of the Institute for Biodiversity Law and Policy, and <a href=\"https:\/\/www.stetson.edu\/law\/international\/biodiversity\/contact-biodiversity-environmental-law.php\" target=\"_blank\" rel=\"noreferrer noopener\">Erin Okuno<\/a>, assistant director of the institute, co-authored with a team of attorneys an amici brief in support of the injunction. They pointed out that utilizing science is critical to achieving goals of the CWA, but the EPA and Army Corps disregarded the available science when crafting the new rule.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Issues<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAlthough the Agencies concede the importance of science, they largely ignored the scientific understanding of how streams and wetlands contribute to the chemical, physical, and biological integrity of downstream waters,\u201d they wrote in the brief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Agencies acted arbitrarily and capriciously by failing to inform themselves\u2014and the public\u2014about the 2020 Rule\u2019s significant negative effects. The 2020 Rule\u2019s reduction of Clean Water Act protection threatens irreparable harm to every American who benefits from and relies on the integrity of the Nation\u2019s waters.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only other <a href=\"https:\/\/policyintegrity.org\/documents\/Amicus_Curiae_Brief_of_the_Institute_for_Policy_Integrity.pdf\">amicus brief<\/a> in the case is from New York University\u2019s Institute for Policy Integrity.
