Virelli III<\/a><\/figcaption><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">At the turn of the 20th century, there was a big debate over worker safety laws limiting how many hours someone could work in a day, according to Lou Virelli, who teaches Constitutional Law at Stetson University College of Law in Florida.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the name of product and employee safety, governments mandated a workday shorter than 10 hours.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe argument was from employers and employees. The employees said, \u2018If I want to work those longer hours, I should be able to,\u2019\u201d Virelli said. \u201cIn 1905 the Supreme Court said \u2018it is your right to decide what your workday should look like and we will not allow the legislature to limit your choices.\u2019 \u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, 30 years later, the Supreme Court took another look at the issue and said the legislatures can infringe on the hours a person works. This was during the New Deal and views on workers\u2019 rights had changed, he said.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Virelli stressed that the current mask debate has nothing to do with the Constitution.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPeople involve the Constitution more often than it applies. If you don\u2019t like your mask, you can complain that they are not a good idea, but you don\u2019t have a constitutional right not to wear one,\u201d he said.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The general consensus is it\u2019s a free country and therefore the government can\u2019t tell citizens what to do.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSince the invention of laws, we have been limiting people\u2019s choices,\u201d Virelli said. \u201cA large part of what law does is it protects, but then it invariably infringes on other people\u2019s limits.\u201d<\/p>\n\n\n\n<p style=\"border-top: 1px solid #cccccc;width:100px;margin: 20px 0px 15px 0px !important;\"><\/p>\n\n\n\n<p style=\"font-size: 11.5px;line-height:18px;padding-bottom:15px;\">This article was originally published on the Legal Examiner website on Aug. 13, 2020, with the headline, &#8220;<a href=\"https:\/\/www.legalexaminer.news\/2020\/08\/face-masks-just-the-latest-of-public-safety-battles\/\">Face masks just the latest of public safety battles<\/a>.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Louis J.
