The Ukraine native ultimately published an <a href=\"https:\/\/www.stetson.edu\/law\/lawreview\/media\/2017%205%20-%20Kamensky%5B1%5D.pdf\">article in the <em>Stetson Law Review<\/em><\/a> in 2016 and another in the <em>Mississippi College Law Journal<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He <a href=\"https:\/\/www2.stetson.edu\/law\/news\/index.php\/2017\/06\/23\/visiting-professor-ukraine-returns-teach-comparative-criminal-law-court\/\">returned to campus as a visiting professor in 2017 and 2019<\/a> and taught an introductory course in comparative criminal law that examined the similarities and differences between criminal law in the U.S. and European countries, namely Ukraine and Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Currently in an undisclosed location, Kamensky has seen the extensive toll of Russia\u2019s invasion of Ukraine close up. He recently wrote about the impact it\u2019s having on day-to-day functioning of the justice system in Ukraine for <a href=\"https:\/\/lalawyer.advanced-pub.com\/?issueID=37&amp;pageID=23\" target=\"_blank\" rel=\"noreferrer noopener\">the latest edition of <em>Los Angeles Lawyer<\/em><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His article, titled \u201cUkraine\u2019s Court System Operating Despite Bombardment,\u201d looks at the resilience Ukraine\u2019s justice system has shown amid the violence: \u201cthe country\u2019s judicial system,\u201d Kamensky writes in the article\u2019s opening paragraph, \u201cis still functioning, albeit in emergency mode.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The courts\u2019 ability to do so varies by region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In communities experiencing heavier violence, appellate and local courts have completely ceased to function.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time of his writing, he notes, about one fifth of the country\u2019s appellate and local courts are not currently functioning, and dozens of Ukraine\u2019s 777 courthouses have been badly damaged, if not destroyed. Kamensky even shared a photo of extensive damage to his own office that resulted from shelling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judges and courthouse staff in these areas have been relocated to other areas and carry out their work remotely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One major challenge, Kamensky writes, is the handling of incarcerated individuals and those in custody awaiting legal proceedings \u2013 but many of the tools that helped keep the justice system moving during the height of the Covid-19 pandemic are proving useful in these circumstances.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2022\/07\/Photo_Dmitriy-Kamensky-768x1024.jpg\" alt=\"A headshot of Ukrainian legal scholar Dmitriy Kamensky.\" class=\"wp-image-31446\" width=\"227\" height=\"302\"\/><figcaption>Ukraine native Dmitriy Kamensky was a Fulbright vising scholar at Stetson Law in 2015 before returning to teach in 2017.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">\u201cSuch challenges in the temporarily controlled jurisdictions are met with the use of digital tools, e.g., court video- and audio-conference systems, electronic document filing, and e-signing within the new nationwide E-Court system (a web-based platform for the convenience of case parties and court members),\u201d Kamensky writes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even as they operate under duress, he notes, judges are donating half their salaries to Ukraine\u2019s defense efforts, and those working within the country\u2019s justice system remain committed to carrying out their important work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEven in the face of hostilities, stress, and mounting pressures, the national courts are going beyond their limits to deliver justice to those who deserve it \u2013 ordinary Ukrainian citizens on the ground in this conflict,\u201d he writes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kamensky\u2019s work was accompanied by a piece written by Ukrainian Supreme Court Justice Mykola Mazur on the current state of the country\u2019s Supreme Court operations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The original article appears in the June 2022 edition of <em>Los Angeles <\/em>Lawyer, a publication by the Los Angeles County Bar Association.
