{"id":33503,"date":"2025-10-10T15:26:42","date_gmt":"2025-10-10T19:26:42","guid":{"rendered":"https:\/\/www2.stetson.edu\/law\/news\/?p=33503"},"modified":"2025-10-10T15:26:43","modified_gmt":"2025-10-10T19:26:43","slug":"alumni-vli-support-better-access-to-va-claims-docs","status":"publish","type":"post","link":"https:\/\/www2.stetson.edu\/law\/news\/index.php\/2025\/10\/10\/alumni-vli-support-better-access-to-va-claims-docs\/","title":{"rendered":"Alumni, VLI Support Better Access to VA Claims Docs"},"content":{"rendered":"<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"590\" height=\"391\" src=\"https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2025\/10\/VLI-Amicus-news-preview-October-2025-1.jpg\" alt=\"Three young alumni stand with purple shirts promoting Stetson's Veterans Law Institute.\" class=\"wp-image-33505\" srcset=\"https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2025\/10\/VLI-Amicus-news-preview-October-2025-1.jpg 590w, https:\/\/www2.stetson.edu\/law\/news\/wp-content\/uploads\/2025\/10\/VLI-Amicus-news-preview-October-2025-1-500x331.jpg 500w\" sizes=\"auto, (max-width: 590px) 100vw, 590px\" \/><figcaption class=\"wp-element-caption\">Left to right: Mary Samarkos &#8217;20 and Morgan Zimarakos &#8217;20 of Stetson\u2019s Veterans Law Institute; Vasilios &#8220;Billy&#8221; Zimarakos &#8217;20 <\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Members of the Stetson Law community are using their expertise to help make it easier for veterans to apply for benefits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an amicus brief filed on behalf of the National Law School Veterans Clinic Consortium, they are asking the U.S. Court of Appeals for the Federal Circuit to require the Department of Veterans Affairs to comply with a statute requiring it to provide benefits applications to veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The brief, submitted October 1, supports the petitioner in a request for certification of a class action case \u00a0 involving veterans who do not have access to technology or expertise that would give them a greater chance of securing the benefits they are due. <strong>Morgan Zimarakos<\/strong> &#8217;20 and <strong>Mary Samarkos<\/strong> &#8217;20 of Stetson\u2019s Veterans Law Institute, along with <strong>Vasilios Zimarakos<\/strong> &#8217;20 and <strong>Yelena Duterte<\/strong> (University of Illinois at Chicago Law) collaborated on the document.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>&nbsp;A potential undue burden<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Veterans who submit an Intent to File for benefits receive letters in the mail that acknowledges that the VA has received their submission and\u00a0refers them to a <a href=\"https:\/\/www.va.gov\/find-forms\/\">search engine<\/a> containing nearly 1,000 forms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some may find it challenging to use, while others lack access to the tech that would allow them to access it entirely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf the search term used does not produce results, a link to a list of 992 separate entries populates. This list does not provide any information instructing claimants on what each form is used for, or which to submit in their situation,\u201d the brief points out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, the VA provides clear-cut instructions to staff, including a chart, to help them determine the right form a claimant should fill out based on the benefit sought, the brief notes, and thus can send claimants the correct paperwork.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Advocates for veterans say the current practice violates a law requiring \u201call instructions and forms\u201d be furnished to veterans claiming benefits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPut simply, VA provides its adjudicators with more comprehensive guidance and information concerning these forms than it provides to the claimants required to complete them,\u201d the brief argues.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Better access to support for veterans, families<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stetson Law\u2019s Veterans Law Institute and Veterans Advocacy Clinic are driven to support those who have served in the U.S. Armed Forces as they pursue what is due to them, whether they are seeking pension or disability benefits. VLI and VAC faculty, staff, students, and supporters are thrilled to be part of a robust nationwide community of advocates who share this passion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This case is a significant example of the challenges veterans face as they seek benefits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is an absolute privilege to work on this case,\u201d said <strong>Morgan Zimarakos<\/strong>, interim director of the Veterans Advocacy Clinic. \u201cAlthough it seems clear-cut to us what the outcome ought to be, it is a clear example of how we can help identify opportunities to better serve veterans.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zimarakos said she is proud to be part of a team that includes her husband, Vasilios, as well as Samarkos, both of whom are veterans.
