Privacy and Abortion Prosecutions
By reversing Roe v. Wade (1973), the Supreme Court of the United States in Dobbs v. Jackson (2022) opened the door for states to initiate criminal investigations and prosecutions relating to women obtaining abortions.
What role do federal Constitution rights, such as the Fourth Amendment, as well as parallel state constitutional protections, play in protecting access to potential evidence (location data, online searches, data from health apps, information relating to physicians or medication, etc.)? How will this potential evidence intersect with other constitutional rights?
