Call for Research Assistants

Professor Andrew Milne is putting out a call out for research assistants interested in researching inheritance, elder care, and civil procedure.  More specifically, he has these two questions:

1. Why is there no homestead exemption to Medicaid estate recovery?   (If homeowners use Medicaid for elder care, Medicaid can seize their home equity upon permanent institutionalization or death, in contrast to homestead protections for consumer debt.)
2. Why do federal courts lack jurisdiction over probate matters that would otherwise qualify for diversity jurisdiction?
