Proposals to Amend the SBA Constitution & By-Laws

The Constitution & By-Laws Committee of the Calvin Kuenzel Student Bar Association and the SBA Legislative Council has approved one change to the Constitution of the SBA. This proposal now needs YOUR approval to be incorporated into the official Student Bar Association Constitution. The below proposal will be posted on Engage for a public vote of the campus body on Tuesday, October 17th – Thursday, October 19th

The proposal would require the SBA Vice President and SBA Vice President of Part-Time Students to have A) served as an executive council member B) have served as an SBA committee chair during their 2L year, or C) have served as an SBA class representative for two semesters prior to their election. The intent of the Constitution and By-Laws Committee is to ensure the SBA Vice President and SBA Vice President of Part-Time Students are each qualified to assume the role of SBA President if the time should ever arise, because the President of SBA is required to meet the above criteria. Additionally, the Constitution & By-Laws Committee of the Calvin Kuenzel Student Bar Association has proposed two changes to the internal By-Laws of the SBA. Your SBA class representatives will vote on these proposals at the Student Bar Association meeting scheduled for Tuesday, October 24th at 12:00pm in F&R Courtroom

The FIRST proposal would require the Parliamentarian, rather than the President of the SBA, to chair SBA votes concerning the appropriation of SBA funds, the approval of changes to the SBA constitution and by-laws, and the removal of SBA officers and representatives. The intent of the Constitution and By-Laws Committee is to ensure impartiality when your class representatives vote to approve/deny critical campus activities. The SECOND proposal would allow the SBA Constitution & By-Laws Committee to issue non-binding, advisory opinions (in other words opinions on matters of constitution and by-law interpretation) in cases where a question of how to properly proceed with SBA business is raised by an SBA officer or representative. The intent of the Constitution and By-Laws Committee is to ensure the SBA can run efficiently and without uncertainty. Please see attached PDF #2 for more information!
