From the King to the Colonies is a general review of sovereign immunity. This article tracks the doctrine from its birth in the English common law through its exportation to the United States federalist system of government, with a focus on the doctrine’s application within the state of Florida. While the article answers many questions about where sovereign immunity arose and why, it also highlights many of the unresolved issues surrounding the doctrine's application in Florida and concludes with an appeal to the Florida Supreme Court to “still the waters” and clarify the law.
